A secured promissory note is a legal written agreement that provides an outline of a loan’s terms. The note is “secured” because it is backed by a borrower’s pledged collateral. In the event of an uncured default, the borrower’s pledged assets would be taken possession of by the lender. The instructions below detail the content requirements of the secured note.
How to Write
Step 1 – The first step is to download the document. Use the links at the top of the page to download the template in your selected format.
Step 2 – The opening paragraph (on the first page of the template) should be filled out in the following manner:
- Submit the date in the given format.
- Enter the name and address of the borrower.
- Fill in the name/address of the lender.
- Provide the principal sum of the note/loan.
- Enter the agreed interest rate (per annum).
Step 3 – Payments:
- Provide the payment method by checking the box that corresponds to the agreed upon method.
- Should “Installments” or “Interest Only” be the chosen method, the monthly/weekly due date must be provided.
Step 4 – Due Date:
- Submit the date in which the full sum of the note is due by. Enter the date in the appropriate format.
Step 5 – Interest Due in Event of Default:
- Provide the agreed upon interest rate that will be applied should the borrower default on the note/loan.
Step 6 – Late Fees:
- Submit how many days the borrower will have to make a past-due payment.
- Provide the late fee amount that will be applied to the balance/payment if the borrower misses the past-due time period.
Step 7 – Acceleration:
- Enter how many days the borrower will have to cure a default on the note/loan.
Step 8 – Security:
- Submit what the pledged assets will be be (i.e. collateral).
Step 9 – Signatures:
- Submit the date of signing.
- Provide the names of the lender/borrower.
- The lender/borrower must sign their names.
- AND
- The witnesses must print/sign their names in the allotted input sections.
